Terms of service
1. ACCEPTANCE OF TERMS
By placing an order with Salem Balloons & Flowers, LLC, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this agreement.
This agreement applies to all products and services provided by Salem Balloons & Flowers, LLC (“SBF,” “we,” “our”), including but not limited to event décor, rentals, balloon arrangements, floral products, gifts, and specialty services.
Completion of a purchase constitutes acceptance of these terms and conditions.
For certain event décor services and rental reservations, customers may also be required to confirm acceptance through an electronic agreement checkbox before completing their reservation.
2. BOOKINGS & PAYMENT
All orders are processed on a first-come, first-served basis.
Full payment is required to secure your order date and reserve availability.
Payment plans may be available through the Shop app or other third-party payment providers. Any payment plan arrangements are managed through the selected payment provider and do not alter the requirement that the order must be secured before services or products are reserved.
Prices are subject to change without notice.
We reserve the right to refuse or cancel service at any time.
Third-Party Vendor Payments
Salem Balloons & Flowers accepts payment only for products and services provided directly by Salem Balloons & Flowers.
Each vendor is responsible for their own contracts, invoices, and payment collection.
Salem Balloons & Flowers does not collect, process, transfer, reimburse, or distribute funds on behalf of third-party vendors.
3. EVENT INFORMATION & CLIENT RESPONSIBILITY
The client is responsible for providing accurate and complete event details, including:
- Full venue address
- Contact name and phone number
- Event date and start time
- Setup access time
- Venue rules, restrictions, and requirements
Failure to provide accurate information may result in delays or incomplete setup, for which SBF is not responsible.
4. SETUP, DELIVERY, ACCESS & POST DELIVERY
It is our responsibility to arrive on time.
It is the client’s responsibility to ensure timely access to the venue.
We are not responsible for delays caused by:
- Lack of access
- Venue restrictions not disclosed
- Third-party vendors
- Weather or unforeseen circumstances
Post-Delivery Modifications
To ensure the safety, appearance, and performance of every installation, Salem Balloons & Flowers recommends that no products be applied to, and no modifications be made to, the installation after delivery unless performed or approved by our team.
Salem Balloons & Flowers cannot assume responsibility for the performance, appearance, structural integrity, safety, or longevity of any installation that has been modified, treated, relocated, repaired, supplemented, or otherwise altered by others after delivery.
This includes, but is not limited to:
- Application of Balloon Shine or other treatment products
- Addition or removal of balloons or décor elements
- Relocation of the installation
- Unauthorized repairs or modifications
Any post-delivery alterations performed by individuals other than Salem Balloons & Flowers void any guarantees related to the installation from the time those alterations are made.
5. SET-N-GO & NON-RENTAL DECOR
For decorations that do not include rentals:
Service is considered complete upon delivery or setup.
No takedown service is included unless specifically stated.
The client assumes full responsibility after delivery.
6. RENTALS & DAMAGE RESPONSIBILITY
All rental items, including but not limited to marquee letters, numbers, props, carts, and structures:
- Remain the property of Salem Balloons & Flowers
- Are for display purposes only
- Must not be climbed, sat on, moved, or misused
The client is responsible for:
- Any damage, loss, or theft
- Guest misuse of equipment
- Full replacement or repair costs
7. THIRD-PARTY SERVICES
SBF is not responsible for:
- Failures or delays caused by other vendors
- Any impact third-party services may have on our setup
- Conditions created by third-party installations or modifications
8. CANCELLATIONS & CHANGES
Cancellation requests, refunds, and applicable fees are handled according to Salem Balloons & Flowers’ Cancellation, Return & Refund Policy available on our website.
Because many of our products and services are custom-designed, perishable, event-specific, or prepared specifically for each client, cancellation eligibility and refund amounts vary depending on the type of product or service purchased.
Work may begin immediately after booking, including but not limited to:
- Design preparation
- Material sourcing
- Specialty item ordering
- Inventory allocation
- Scheduling and production planning
Last-minute changes may not be accommodated.
Event date changes and rescheduling requests are subject to availability and the Rescheduling Policy outlined in our Cancellation, Return & Refund Policy.
9. PRODUCT VARIATIONS & ACCURACY
Colors and materials may vary slightly due to availability, lighting, photography, and environmental conditions.
Substitutions may occur when necessary.
Any replacement will be of equal or greater value.
Exact replication of inspiration images cannot be guaranteed due to differences in materials, availability, and creative interpretation.
10. DISCLAIMER OF WARRANTIES
All products and services are provided “as is.”
We do not guarantee:
- Exact color matching
- Balloon longevity due to environmental conditions
- Exact replication of inspiration images
- Performance of installations altered after delivery
- Outdoor performance affected by weather conditions
11. PHOTO & MARKETING RELEASE
By purchasing our services, you grant permission for SBF to photograph and use images of our work for marketing and promotional purposes.
If you do not wish to have your event photographed or shared, please notify us in writing before your event date.
12. SAFETY & RESPONSIBILITY NOTICE
No Outdoor Releases (Oregon Law)
Helium-filled balloons must not be released outdoors.
Balloon releases are prohibited in Oregon and may violate local regulations.
Children & Supervision
Balloons can pose a choking hazard.
Children under 8 must be supervised at all times.
Keep uninflated balloons away from children and discard broken balloons immediately.
Helium Safety
Never inhale helium.
Doing so can cause serious injury or death.
Customer Responsibility
Once balloons or products are delivered or picked up, they are under your care and responsibility.
SBF is not liable for damage or injury resulting from handling, use, or misuse after delivery.
13. BALLOON CARE & ENVIRONMENTAL CONDITIONS
Heat may cause balloons to expand or burst.
Cold may cause balloons to shrink or deflate.
Avoid placing balloons:
- In direct sunlight
- Near vents
- Near extreme temperatures
- Outdoors unless specifically designed for outdoor use
We are not responsible for balloon performance after delivery.
14. GENDER REVEAL & CONFETTI / POWDER POLICY
The following applies to all gender reveal effects and installations:
Non-Toxic Materials
All powder and confetti materials are non-toxic.
However, powder may stain clothing, skin, hair, or nearby surfaces.
SBF is not responsible for staining or residue.
Safe Distance Requirement
Guests must maintain a safe distance during activation.
The client is responsible for ensuring guests are properly positioned.
Children & Supervision
If children are present:
- Parents/guardians must supervise them at all times.
- Children must be kept away from equipment and activation zones.
SBF may outline a safety zone but is not responsible for supervising children.
Equipment Responsibility
Clients are responsible for ensuring guests do not:
- Touch or interfere with equipment
- Enter restricted areas
- Damage displays
Any damage caused will be the client’s responsibility.
Interior vs Exterior Use
Powder effects are outdoor use only.
Confetti may be used indoors or outdoors, subject to venue approval.
The client is responsible for verifying venue permissions.
Cleanup Responsibility
SBF does not provide cleanup services for:
- Confetti
- Powder residue
Cleanup is the responsibility of the client or venue.
Weather Conditions
SBF is not responsible for:
- Wind affecting powder direction
- Reduced visual effects due to weather
- Environmental conditions affecting performance
No refunds will be issued due to environmental factors.
Liability Waiver
By purchasing gender reveal services, the client assumes all associated risks and releases SBF from liability related to:
- Staining
- Guest behavior
- Misuse of equipment
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Salem Balloons & Flowers is not liable for:
- Injuries caused by misuse
- Damage after delivery
- Delays caused by external factors
- Indirect or incidental damages
16. GOVERNING LAW
This agreement shall be governed by the laws of the State of Oregon.
17. ELECTRONIC AGREEMENT
By completing a purchase with Salem Balloons & Flowers, LLC, you acknowledge that you have reviewed and accepted this agreement.
Electronic acceptance, payment completion, or confirmation of an order constitutes acknowledgment and agreement to these terms and conditions.
For certain event décor services and rental reservations, customers may also be required to provide additional electronic confirmation before their reservation is secured.
